Terms of Service

Please read these Terms carefully. They are a legal agreement between you and ReUp365 that governs your use of the app. By downloading, accessing, or using ReUp365, you agree to these Terms. If you do not agree, please do not use the app.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the ReUp365 mobile application and related services (collectively, the "App"), operated by ReUp365 ("ReUp365," "we," "us," or "our"). By using the App, you confirm that you are at least 13 years old and capable of entering into a binding agreement.

2. Description of the Service

ReUp365 is a grocery pantry tracking application that helps you track household inventory, estimate when items may run low, receive alerts, and reorder items through connected third-party services. The App uses features such as barcode scanning, receipt scanning, and optional connections to grocery store accounts and delivery services.

    ReUp365 is a tool to help you manage your pantry. It provides estimates and reminders, but it does not guarantee accuracy of inventory counts, product data, pricing, availability, or delivery outcomes.
  

3. Your Account and Responsibilities

You are responsible for the accuracy of the information you enter into the App.
You are responsible for maintaining the security of your device and any connected accounts.
You agree to use the App only for lawful purposes and in accordance with these Terms.
You agree not to misuse, reverse-engineer, disrupt, or attempt to gain unauthorized access to the App or its systems.

4. Third-Party Services and Integrations

ReUp365 integrates with third-party services, including but not limited to Kroger (and Kroger family stores), Instacart, Amazon Fresh, and product data providers. These services are operated by independent companies and are governed by their own terms and privacy policies.

ReUp365 does not control and is not responsible for the products, pricing, availability, order fulfillment, delivery, or actions of any third-party service.
When you connect an account or place an order through a third-party service, your interaction with that service is subject to their terms, not ours.
We are not liable for any issues arising from your use of third-party services, including incorrect orders, pricing discrepancies, or delivery problems.

5. Subscriptions and Payments

ReUp365 may offer optional paid subscriptions ("Pro" or similar tiers) with additional features. If you purchase a subscription:

Payment is processed through the Apple App Store, and Apple's terms and billing policies apply.
Subscriptions may automatically renew unless canceled at least 24 hours before the end of the current period, in accordance with App Store rules.
You can manage or cancel your subscription through your Apple App Store account settings.
Refunds are handled according to Apple's App Store refund policies. ReUp365 generally does not process refunds directly.
We reserve the right to change subscription pricing and features, with notice where required.

6. Health, Medication, and Supplement Disclaimer

Important: ReUp365 may allow you to track supplements and medications for inventory purposes only. ReUp365 is not a medical device and does not provide medical, health, dosage, or pharmaceutical advice. Do not rely on the App for any health-related decision, dosing schedule, or medical purpose. Always consult a qualified healthcare professional and follow the instructions provided with your medications. ReUp365 is not responsible for any health consequences resulting from reliance on the App.

ReUp365 is not a HIPAA covered entity. The supplement and medication tracking feature is provided for inventory management purposes only and does not constitute medical advice, a medical record, or a healthcare service. ReUp365 does not store medication or health data on any server — all data remains on your device. Do not rely on ReUp365 for any medical or health-related decisions, dosing schedules, or pharmaceutical guidance. Always consult a qualified healthcare professional regarding your medications and health.

7. Intellectual Property

The App, including its design, logos, text, graphics, and software, is owned by ReUp365 and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission. You retain ownership of the data you enter into the App.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or that inventory estimates, product data, pricing, or notifications will be accurate or reliable.

9. Limitation of Liability

To the fullest extent permitted by law, ReUp365 and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the App or any third-party service accessed through it.

Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ReUp365 and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason. You may stop using the App at any time by deleting it from your device. Provisions that by their nature should survive termination (such as disclaimers, limitations of liability, and indemnification) will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Illinois, unless otherwise required by applicable law.
